HUD Tribal Advisory Committee

HUD formed its first Tribal Intergovernmental Advisory Committee in November 2022 to give Tribal leaders a forum for input on Departmental policy — especially before policies are adopted and implemented.

Like every federal agency, HUD carries a trust responsibility and maintains a government-to-government relationship with Tribal Nations. That relationship is legal and political, not merely consultative, and it obligates the Department to respect Tribal rights of self-government and self-determination in how it designs and administers its programs. The TIAC exists to make that obligation operational at the policy-development stage rather than after the fact.

The Committee implements directives under Executive Orders 13175 and 14112, the Presidential Memoranda on Strengthening Tribal Consultation dated January 26, 2021 and November 30, 2022, and HUD’s longstanding Tribal Consultation Policy. It complements — but does not replace — formal Tribal consultation.

The TIAC meets in person twice a year. Tribal representatives, led by the Co-Chairs, also hold monthly virtual meetings and working sessions supported by ONAP staff. In-person meetings held to date:

Since 2022 the TIAC has produced policy papers and formal recommendations to HUD on the erosion of Indian Housing Block Grant purchasing power, culturally specific housing counseling requirements, interagency barriers affecting Tribes, the appropriations rider blocking Indian Health Service sanitation funds from serving HUD-built homes, Build America Buy America implementation, ICDBG rulemaking, equity in Native housing funding, construction and procurement costs in Indian Country, and regulatory streamlining.

The Committee’s push for better-targeted technical assistance produced new training resources on environmental review, program eligibility, reporting, and funding applications. Its work also prompted collaboration between ONAP and three other HUD offices — Healthy Homes, the CPD Office of Block Grant Assistance, and Choice Neighborhoods — to make those programs work in Indian Country. The TIAC was instrumental in recommending that HUD create Tribal set-asides under programs where the law permits them.
